A Forest City man who police say fired shots at a local night club last year had new charges filed against him.

In Sept. 2013, Earl Spencer Boyce Jr., 36, of Trailwood, Forest City, was charged with one count of assault with a deadly weapon inflicting serious injury with intent to kill, three counts of assault with a deadly weapon inflicting serious injury and one count of possession of a firearm by a felon.

Boyce was charged with these crimes after allegedly shooting several people outside of the Vortex night club on Finley Road in Marion. Three people were injured.

Boyce has an extensive criminal history and has been in custody since the incident.

During the latest grand jury session, Boyce was indicted on one count of intimidating a witness. The grand jury meets to consider if enough evidence is present for a case to be heard in Superior Court.

On Jan. 13, 2014, Lt. Scott Spratt, of the Marion Police Department, was summoned as a witness in McDowell County District Court for the State versus Earl Spencer Boyce Jr. The intimidation consisted of Boyce stating to Spratt, “You’re dead (exploitive).”

Boyce’s next Superior Court date is in September.

The grand jury handed down 182 true bills of indictments during the July session:
