Capps also has warrants for misdemeanor larceny, malicious burning and breaking and entering a motor vehicle.
On March 24, the Marion Fire Department responded to the Kwik Mart on East Court Street in reference to a vehicle fire. When firefighters arrived, they found a 2001 PT Cruiser, owned by Tevin Lanning, on fire in the parking lot of the business.
Lanning told a reporter at the scene that he had been approached by a larger man who was trying to start a fight with him. Lanning left the scene with a friend, only to return to the gas station to find his car on fire. He also reported a jacket and a cooler had been taken from the vehicle.
After authorities viewed surveillance tapes at the store, they discovered the suspect to be Capps.
He is described as a white male, 5’11, 200 pounds, with brown hair and green eyes. He is suspected to still be in McDowell County.
