NOTICE OF SALE Pursuant to the judgment of the District Court entered in the above referenced matter on September 29, 2016, the undersigned Commissioner will expose for sale to the highest bidder for cash at public auction to be held on February 20, 2020 at 12:00 PM at the front door of the Cabarrus County Courthouse in the City of Concord, North Carolina the below listed certain parcel of land situated and being in the City of Concord, Cabarrus County, North Carolina as said land is more particularly described as follows: Commonly known as 220 & 222 Green Drive, Concord, NC 28025 and being all that certain lot or parcel of land situated in the City of Concord, Cabarrus County, NC and being One Lot, a deed of which is recorded in Deed Book 7101, Page 133 of the Cabarrus County Registry, to which deed reference is made for a more complete description as to metes and bounds. Said property bears Real ID No. 11-0040-0156.00 and also further described below, as presented in the Complaint filed April 4, 2016, Cabarrus County Clerk of Courts: FIRST TRACT: (Old Description) One small lot in WEST CONCORD and on the NORTH side of Morris Street and adjoining the property of Lizzie Maxwell and G.F. Maxwell and bounded as follows: BEGINNING at an iron stake in the North edge of Morris Street, a corner of Lot No. 9 and runs with the line of Lot No. 9, N. 32 W. 150 feet to an iron stake a corner of Lot No. 9; thence S. 58 W. 30 feet to an iron stake in an old line, a new corner; thence S. 32 E. 150 feet to an iron stake a new corner; in old line and in the North edge of Morris Street; thence with the North edge of Morris Street, N. 58 E. 30 feet to the BEGINNING. SECOND TRACT: (Old Description) Lying and being in No. 11 Township, and being Lot Nos. 9, 10, 11, and 12 in Block "K" of WEST CONCORD, as surveyed and platted by Q.E. Smith, a copy of which is filed in the office of the Register of Deeds for Cabarrus County. BEGINNING at an iron stake on Morris Street, a corner of Lot No. 8, F.L. Third party purchasers must pay the court costs and any other applicable fees. A cash deposit (no personal checks) of twenty percent (20%) of the purchase price will be required at the time of the sale. Following the expiration of the statutory upset bid period, all remaining amounts are immediately due, owing and payable. Said property will be offered "AS IS, WHERE IS". The Property is sold subject to the Order docketed September 29, 2016 in the Cabarrus County Clerk of Court and lists debts due to the County of Cabarrus. This sale is being held for post-petition debt following the bankruptcy action filed in the United States Bankruptcy Court, Middle District of North Carolina, Case Number B-16-51129 C-13W; proof of the Notice of Termination of the bankruptcy action is filed in Deed Book 13942, Page 225 of the Cabarrus County Registry. The amount of the debt, as of the date of sale is estimated to be $9,000.00, more or less. The amount of the bid deposit shall be $1,800.00 and shall be accepted in either cash or certified funds made payable to the Commissioner, Robert E. Cansler. The mobile home located on the Property has code enforcement violations. The Buyer will be responsible for either demolishing the mobile home or making the necessary repairs to the mobile home in order to bring the structure back into compliance with the City of Concord and Cabarrus County Code of Ordinances within one (1) year of the docketed confirmation of sale.
